Conversion of Leasehold property into freehold property in Noida

Is it finally possible to convert your 99-year leasehold property in Noida to Freehold?

It’s the #1 question I get from clients comparing Noida real estate with Delhi (DDA) or Ghaziabad (GDA). The Short Answer: No, not yet. As of late 2025, there is no active scheme for residential freehold conversion in Noida.

Here is the legal breakdown of where we stand and why this is different from our neighbors:

  1. The Root Cause (1976 Act): Unlike Ghaziabad or Delhi, Noida was established under the UP Industrial Area Development Act, 1976. Under this Act, the Noida Authority retains ownership of the land, and "owners" are technically "lessees" for 99 years. To change this, the Act itself or the state policy needs a significant amendment.

  2. The "In-Principle" Approval (The Cliffhanger): Back in 2018, during its 195th Board Meeting, the Noida Authority actually gave "in-principle approval" for freehold conversion.

  • The Catch: This proposal was sent to the Uttar Pradesh State Government for final legislative approval.
  • Current Status: That file is still pending at the state government level. Despite repeated demands from RWAs and industrial bodies in 2024-25, the final Government Order (GO) has not been issued.
  1. Confusion with "Registry" vs. "Freehold": Don't confuse the recent push for registries (sub-lease deeds) in stalled projects (post-Amitabh Kant Committee report) with freehold conversion.
  • Registry: Gives you legal title for the remaining lease period (99 years).
  • Freehold: Gives you absolute ownership of the land with no lease rent and no lease period.
  • We are seeing progress on Registries, but not on Freehold.

💡 The "Delhi" Comparison: Many owners look at DDA’s conversion schemes or PM-UDAY in Delhi and expect the same here. The difference is that DDA operates under a different central framework that allows this conversion upon payment of a fee. Noida’s framework is currently more rigid.

🔮 What to watch for: There is mounting pressure from industrial associations (like IIA) to allow freehold for industrial plots to improve "Ease of Doing Business." If the government cracks that door open for industries, residential policies often follow suit.

My Advice to Homeowners:

Until a policy is notified, ensure your Lease Rent (One-time or annual) is fully paid up and your Sub-Lease Deed is registered. A clean lease record will be the first eligibility requirement if and when the conversion scheme launches.

👇 Thoughts?

If the scheme launches tomorrow, would you pay a conversion fee (e.g., 5-7% of circle rate) to go Freehold? Or is the 99-year lease secure enough for you?
